Coast Guard Clarification On Ride Sharing


Message from the Coast Guard regarding trip sharing:
These links will provide clarification of the regulations related to charter operations, and ensure that all operators who carry even one hop-on "HO" for a fee holds in their possession a valid Coast Guard license. help.gif censored2.gif censored2.gif help.gif just got a letter from the city of norfolk citing code 29-58 that says " no boat shall be parked in front of a residential dwelling." i checked the code on line and found no reference to boats at all. my mako is parked on the driveway and does not stick out past the sidewalk. have had the boat parked here for more than a year with no problems. the home next door is for sale and the realtor called the city on me iam sure, what a a**hole could not be bothered to talk to me first. my question is about the code is this for real or am i being railroaded by the system? any help will be appreciated.

Unfortunately it is for real. Most of the cities in this area have the same code. Basically the boat must be behind the plane of the house if it is in the driveway and cannot be over a certain height unless it is in the backyard. We just bought a new house last summer and I really pissed my wife off because I would not even look at a house unless it had sufficient boat parking. I see people with boats parked in their driveways all the time and usually you are ok unless someone rats you out. You may be able to fight it. Check with jsuperjeff as he had the same problem in Chesapeake.

Somebody probably complained. I had my Big boat in front of the house (on the street) and it got ticketed, but they said nothing about the bass boat in the drive way, in front of the house. The bass boat sat there for 2 years.

Your boat cant be in the front it has to be parked on the side.It cant even stick out past the front at all.Welcome to Virginia Beach where they let Schriners ride on their hoods of their cars with open alcohol containers and bust locals for drinking in their own front yards.

Just one of many reasons why I have moved out of VB , It's becoming such a "socialist state" haven't had any problems "across the water" I hate having to come across to drop my boat but it's a sad reality sometimes....VB is money hungry!!!! Thanks Myra O !:angry:

Same thing happened to me in VB. Someone didn't like my boat parked in my driveway (pretty sure I know who it was). Meanwhile there is a 12 ft jon boat parked on the street around the corner from my house. I was so mad I walked down to the house with the jon boat and asked if they had gotten a notice. Nope. Just me. The thing is, whoever gave me the notice would have had to drive by this other guys house and they chose not to give him a notice.

I would appeal. The boat and trailer are liscenced vehicles, they are tagged and registered as is your car . The ordinance will not hold up in court. Our local tried to enforce such an ordinance years ago but with no luck. The county or city has no more authority than the State gives it ( The Dillon Law) and that trailer and boat are legal registered vehicles in the State of Virginia. usaflag.gif

The ordinance is one that is only enforced when there is a complaint. I am lucky enough to have neighbors that don't really care to make a complaint (I regularly talk with everyone with 3-4 houses of mine and invite them to parties). Heck, when my boat had some problems (drive would not go up) it sat in the street in front of the house for 3 weeks without a problem. I just made sure to talk with the neighbors to explain the situation. I think Jeff (jsuperjeff) had pretty good luck fighting this in Chesapeake...he did hid homework and it worked out pretty well (Captain Fatbeard didn't even need to be summoned to help out. My dad had a simular problem in Norfolk. He's on a corner lot with the house 6 feet off of the back property line. There is no way to get the boat behind the house. He received a citation for the boat, which was on a gravel parking area next to the carport, but in front of the house. The City told him that the boat can be in front of the house as long as it sits on pavement. So he concreted the gravel area and hasn't had a problem in years. And believe me, the Bayview Civic League would be complaining if they could. I'm just not sure if that was an exception they made for him because of the way the house sits on his lot, or whether that option is open to everyone in Norfolk. Sorry, I know that doesn't help you folks at the Beach.

In va beach the guy stopped by to give me a warning after 5 pm on a Friday! At first I was angry and was thinking of reporting the 12 other boats and rv's in the neighborhood. After thinking about it and realizing that you get back what you dish out I decided not to worry about it. But I leave the boat out in the driveway every weekend I take it out knowing I am making some busy bodied communist neighbor fume! usaflag.gif

When I moved to VA last summer I was shocked to hear about such a stupied law but l got luck and every one on my cul-d-sac thanks that the law is stupied also and have no heart burn when my boat is in the drive way. They tell me it looks alot better that some of the rusted out car that are parked in some driveways.

Would this law (Dillon) apply to private home owner associations? I live in a private association community and is the reason I don't have a boat. I can't park it at my house in view of the street, so I can't keep one. yak1.jpg

NO, it would not apply to a covenant established by a private community or subdivision. It only applies to counties and city's when they enforce or legislate laws that are in contradiction with that of the State.

Huck, I beg to differ with you; each locality has the right to enact and enforce zoning ordinances (as long as they do not contradict state law) and the citation in question is a zoning ordinance violation. Typically, the boat cannot extend beyond the front most portion of your home, depending on how your house situated this may help or hurt you. Make no mistake if code enforcement chooses to enforce the ordinance you will not win.
Norfolk Zoning Code(Ord. No. 42,260, § 42(Exh. XX), 5-9-06)
(e) Parking and storage of boats, trailers and recreation vehicles in residence districts.
(1) Unless parked or stored in a garage, carport or accessory building, such equipment shall be parked or stored behind the nearest portion of any building to any public street; provided, however, that parking shall be permitted elsewhere on the premises not to exceed a 24 hour time limit for the purpose of loading and unloading.
(2) No such equipment may be parked or stored in any side yard not adjacent to a street if it exceeds six feet in height above the ground; provided, however, that masts, antennas, vent stacks, windshields or other minor accessories may exceed this height limit.
(3) Equipment exceeding the limitations set forth in section 15-5.1(e)(2) above, may be parked or stored outdoors only in the rear yard not closer than five feet to a rear or side lot line. Any equipment so parked shall be further subject to the requirements for accessory buildings set forth in Chapter 13, section 13-5.
